General Conditions of Engagement
Pursuant to Royal Decree 1906/99, 17 December, which regulates electronic contracts with general conditions, and to the Retail Trade Planning Act (Law 7/1996, 15 January) applicable to distance selling under article 38 and subsequent articles, IMAGINARIUM S.A. states that
To employ the services offered by ItsImagical (Imaginarium, S.A.), the user must be authorised to enter into contracts in accordance with the laws of their country.
Purpose of the contract
The purpose of this contract is the sale of products and services for children and their families. Their specifications are given on the corresponding pages of this website, as well as the details of each transaction that is performed in this environment.
Identification of supplier
The supplier of the products and services contracted by the user is ItsImagical ( Imaginarium S.A.), with its registered office in Plataforma Logística de Zaragoza - C/ Osca, nº4 - 50197 Zaragoza (Spain) C.I.F. A50524727. The company is registered in the Zaragoza Mercantile Registry, volume 1.304, file 8, section -7250, entry 1. ItsImagical, Imaginarium S.A. is registered in the Treasury's Registry of Distance Selling Companies, number -NEVA-2007/0740/02/50/9/V, in compliance with Royal Decree 225/2006, 3 February. Completing and sending the order form is considered as acceptance of the terms of the contract, and under no circumstances shall it be considered as a commercial proposal.
These General Conditions shall be applied and interpreted in accordance with Spanish law in all cases where it is not explicitly established. The parties, expressly forgoing any other jurisdiction that may apply, are subject, except in cases in which it is not legally permitted, to the jurisdiction and authority of the Courts of the city of Zaragoza (Spain) for the resolution of any issues that may arise between them.
Price and offer validity period
Orders will be delivered by ItsImagical, (Imaginarium S.A.) with its own resources or with a transport agent that it designates. The orders will be delivered to the address indicated by the purchaser together with a card with the text provided by them. Therefore, ItsImagical, (Imaginarium S.A.) does not assume any liability whatsoever when the delivery cannot be carried out as a result of inaccurate or incomplete data, or if the delivery cannot be completed when the recipient is not at home. Notwithstanding the above, Imaginarium S.A. will take the measures required of a diligent retailer to make the delivery as soon as possible, to the satisfaction of both the sender and the recipient. For deliveries to hospitals, public organisations and other buildings in which there are access restrictions for the general public, Imaginarium S.A. cannot guarantee that they will be made directly to the recipient. Delivery is considered made and free of liability when the order has been made available to the recipient at the reception area or other location serving as an access control point.
Information and Enquiries
ItsImagical, Imaginarium S.A. guarantees the delivery of orders in the times indicated in the corresponding section on the website, based on the transport system and the destination chosen by the purchaser. The order collection and delivery service is unavailable on Saturdays, Sundays and bank holidays. This fact must be taken into account when calculating delivery dates. During periods in which there are special circumstances (special dates such as Christmas, transport strikes, unexpected events...), deliveries may be delayed.
ItsImagical, Imaginarium S.A. does not guarantee deliveries at specific or set times. If the purchaser indicates a specific delivery date or, on that date, indicates a preference for a particular time of day, this will be taken as a guideline only. ItsImagical, Imaginarium S.A. must inform the transport agent of this so that the instruction is respected as far as possible, with no further obligation or responsibility.
Intellectual Property and Other Rights
As you will have seen, when placing the order on the web, the corresponding invoice arrived at the e-mail address you gave us and it accompanies the requested products.

All products pass through strict safety controls, to guarantee that the materials, manufacturing processes and selection meet all European standards. Our goal is that the toys reach your hands as soon as possible, and in perfect condition. For this reason, we have a logistics platform that specialises in children's products. We want to offer you the best service possible. For this reason, you can return any of our products by contacting us through the Customer Service Line by writing to firstname.lastname@example.org. We will answer any questions you may have about your order, arrange to pick up the product at your home free of charge, and either give you another product in exchange or give you a refund. Remember, however, that you must keep the original packaging in perfect condition. Remember that all returns must be processed within 1 month of the purchase, and the sales receipt must be presented. Personal hygiene products, CDs or software that have been opened and other products that, due to their nature, cannot be returned, will not be accepted for return.
